Abstract
The right to a fair trial is a fundamental safeguard to ensure that
individuals are protected from unlawful or arbitrary deprivation of their human
rights, such as the right to freedom, liberty and security of persons relating
to the administration of justice in both civil and criminal proceedings. This
paper examined the jurisprudential issues involved in the concept of a fair
trial. This was achieved by adopting the doctrinal method of research. This
work found that due to lack of universally acceptable definition, this has made
it difficult for courts, legal practitioners and litigants to enforce the right.
