Abdul Nasir Hamidi

Human dignity or being human needs to be respected, either his/her soul, property, honor, status or etc. Unfortunately, sometimes it has been witnessed that human being are confronting outrage, accusation, abuse, humiliation, etc. that affect their soul, property, honor, and status. These all acts are considered illegal and prohibited in Holy Quran, Hadiths and Jurisprudence. If a person is exposed to such disgraceful activities, its status has to be rehabilitated and restored, therefore both material and intellectual remedies are suggested and approved by law, that scholars know it as General Rehabilitation/ Restoration of Prestige.
Likewise, while a person commits a crime, he himself became the one who affects his status and honor in the society, as a result he/she loses some political, social, and civil rights and privileges. Despite, the person’s honor, and status must be redressed, that is considered Special Rehabilitation/ Restoration of Prestige Provisions.
If someone’s prestige is affected due to a crime committed by others or itself, in both situation one’s prestige has to be recovered. The Islamic law indicates it as repentance and remorse, though substantive law suggests to ways, Statutory Rehabilitation/Restoration of prestige and Judicial Rehabilitation/Restoration of Prestige.
